1. Acceptance
By accessing or using Spin Check(the “Service”), creating an account, or continuing to use the Service after these Terms are posted, you agree to be bound by this Terms of Service (“Terms”). If you do not agree, you may not use the Service.
2. Ownership
The Service, including its software, design, branding, documentation, and all related intellectual property, is owned exclusively by ScasticRacks LLC(the “Owner”).
No person, organization, or entity acquires any ownership interest in the Service by using it, contributing content, or assisting with its operation unless expressly agreed in writing by the Owner.
3. Limited license
The Owner grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Service only for its intended purpose and only while your account remains in good standing. You may not copy, modify, distribute, sell, sublicense, reverse engineer, or create derivative works from the Service except as expressly permitted by the Owner in writing.
4. Mandatory compliance with stop-use requests
The Owner may, at any time and for any reason, direct any user, operator, host, collaborator, or other entity to cease use of the Service, cease operating an instance of the Service, or cease any activity related to the Service (“Stop-Use Request”).
You agree to comply immediately and fully with any Stop-Use Request issued by the Owner or the Owner's authorized representative. Failure to comply may result in suspension or termination of access and may expose you to civil and criminal liability, including injunctive relief and any other remedies available under applicable law.
5. Accounts and conduct
You are responsible for your account credentials and for all activity under your account. You agree not to misuse the Service, interfere with its operation, attempt unauthorized access, or use it in violation of applicable law or the rights of others.
6. User content
You retain ownership of content you upload (such as audio sets and profile materials). You grant the Service a limited license to store, process, and display that content solely to operate the review and scheduling workflow. Staff may access submitted materials as part of the review process described in the application.
7. Suspension and termination
The Owner may suspend or terminate any account or access to the Service at any time, with or without notice, including for violation of these Terms or failure to comply with a Stop-Use Request.
8. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the fullest extent permitted by law, the Owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from or related to your use of the Service.
10. Changes
The Owner may update these Terms at any time. Material changes will be reflected by updating the “Last updated” date above. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
